The property of 349 LaHave Street (PID 60042538), known as the “cineplex property”, was a movie theatre which closed its doors in April 2024. The property is subject to a development agreement because it is within the LaHave River Development Agreement Area (LRDAA). The Town is negotiating to purchase a portion of the land to relocate a wastewater pump station to higher ground and remove it from the river’s edge where it is currently located.
With the policy as currently stated and implemented in the MPS and LUB, a change of use within the existing structure on the property is not allowed without undertaking a full development agreement process. To enable a change in use, staff is proposing an amendment to the current policy to allow existing buildings to be occupied with any of the permitted uses of the zones via a change of use process, rather than a development agreement process.
